Palestinians Challenge Germany’s Arms Exports to Israel
The case was initiated by five individuals from Gaza and is backed by both Palestinian and German human rights organizations.
The European Center for Constitutional and Human Rights (ECCHR) disclosed the legal action in an official release.
"As long as the German government approves arms deliveries to Israel that can be used in Gaza, it is violating its constitutional duties of protection and international law," the ECCHR emphasized.
The organization urged, "The German government must fulfill its responsibility: no arms exports to Israel while there is a risk of systematic violations of international law."
This recent move comes after earlier attempts to challenge the exports in local and regional courts were dismissed over the past two years.
The complainants argue that their core rights to life and personal safety, as outlined in Germany’s Basic Law, are being threatened. They also claim a breach of their right to adequate legal recourse.
In August, Chancellor Friedrich Merz’s coalition government revealed it would suspend approvals for new arms shipments that might be deployed in Gaza.
This decision came in response to increasing criticism both internationally and at home. Nevertheless, the government has not pledged to halt the delivery of weapons already authorized.
The ECCHR pointed out that licenses already granted continue to be fulfilled, despite alerts from United Nations agencies and global watchdogs regarding alleged war crimes, crimes against humanity, and genocide occurring in Gaza.
